ReferralFit Terms of Service
Draft · Not yet effective
These terms are an agreement between you and Matt Brown, Freedom Interventions ("we", "us"), the publisher of ReferralFit. They cover the ReferralFit app, the center portal for treatment programs, and this website (together, "the Service"). By creating an account or using the Service, you agree to them.
1. Professional use only
The Service is a business tool for addiction-intervention and recovery professionals, their staff, and treatment programs that manage their own directory listings. You must be at least 18 and use the Service in the course of your professional work. It is not intended for patients, clients, or families, except that a family may use a practice's intake link to ask that practice to call them back; that relationship is between the family and the practice.
2. Not medical advice, and not an emergency service
ReferralFit does not provide medical, clinical, legal, or financial advice, and it does not provide treatment. Match results, fit scores, estimates, directory information, bed counts, and credential information are aids to your own professional judgment. They may be incomplete or out of date. Verify benefits, network status, credentials, availability, and cost directly with the program and the plan before you rely on them.
The Service is not an emergency service and is not monitored for emergencies. If someone is in immediate danger or may have overdosed, call 911. If someone is thinking about suicide, call or text 988.
3. Your account and your workspace
Give accurate information when you create an account, keep your password secure, and tell us promptly if you believe your account has been used without your permission. You are responsible for activity under your account. A workspace owner is responsible for the teammates they invite and for removing access when someone leaves the practice.
4. Your content and de-identification
You are responsible for everything you and your teammates enter into the Service, and for having the right to enter it, including any permission you need from a family to store their contact details. Keep the referral ledger and match profiles de-identified, follow the App's instructions about what not to enter, and do not enter protected health information where the App asks you not to. Only the information you choose to share leaves your workspace, as described in the Privacy Policy.
You are responsible for complying with the laws and professional rules that apply to your practice, including privacy, confidentiality, and healthcare laws. We make no representation that the Service meets the requirements of any particular law or standard for your use. You decide whether it is appropriate for your practice.
You keep ownership of your content. You give us permission to host, store, process, and display it only as needed to run the Service for you, and to include it in aggregate, anonymized statistics as described in the Privacy Policy.
5. No pay-for-placement
Treatment programs cannot pay for placement or ranking, and claiming or maintaining a directory listing does not affect ranking. You agree not to use the Service to offer, pay, solicit, or receive anything of value in return for referring patients in violation of the Eliminating Kickbacks in Recovery Act (EKRA), the federal Anti-Kickback Statute, state patient-brokering laws, or any similar law. If you have a financial relationship with a program, record it in the App so it is disclosed.
6. The shared directory and programs
Directory listings are business information about programs and professionals. Submissions are reviewed before they appear, and we may edit, decline, or remove listings. A program that claims a listing must be authorized to act for that program and must keep its information accurate. Verification status is decided by ReferralFit.
7. Acceptable use
Do not:
- use the Service for anything unlawful, deceptive, or harmful to the people it is meant to help;
- contact a family or a program in a way they have not agreed to, or misuse an intake link;
- try to access another practice's workspace, or probe, disrupt, or overload the Service;
- copy, scrape, or resell the directory or any part of the Service.
8. Optional third-party services
Some features use services you set up yourself, such as AI-drafted follow-ups with your own Anthropic account, or links to your own Square invoices and PandaDoc agreements. Those services are governed by their own terms, and any fees they charge are between you and them.
9. A free service
ReferralFit is free to use. Practices and treatment programs pay no fees, and there is nothing to buy in the App. If we introduce paid features, we will tell you before you are charged anything, and you will not be charged without agreeing.
10. Deleting your account, and ending access
You can stop using the Service at any time and delete your account in the App (Workspace and settings, the gear icon at the top of the screen, then Delete account), or by emailing us from your account address. Deletion is handled as described in the Privacy Policy. We may suspend or end access for anyone who breaks these terms or puts others at risk, and we will try to tell you first when it is reasonable to do so.
11. Disclaimers
The Service is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including fitness for a particular purpose, accuracy, and non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or that information in it (including directory listings, bed counts, and scores) is complete or current.
12. Limits on liability
To the fullest extent the law allows, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill, arising from your use of the Service. Our total liability for any claim about the Service is limited to one hundred U.S. dollars (US$100). Some places do not allow these limits, so they may not all apply to you.
13. Changes to these terms
We may update these terms. When we make a material change, we will post the new version here with a new date and tell you in the App or by email before it takes effect.
14. Governing law
These terms are governed by the laws of the State of Oregon, without regard to its conflict-of-law rules.
